Draft Notification on Exemption of Certain Industries from Prior Consent to Establish and Operate under the Air Act

The Ministry of Environment, Forest and Climate Change has issued a draft notification to exempt certain categories of industries from the mandatory requirement of obtaining prior Consent to Establish (CTE) and Consent to Operate (CTO) under the Air (Prevention and Control of Pollution) Act, 1981. This initiative aims to enhance ease of doing business and reduce compliance burdens by eliminating the duplication of procedures for industries already covered by Environmental Clearance (EC) or categorized as 'White' by the CPCB. Industries categorized as 'White' will only need to provide a self-declaration to the relevant State Pollution Control Boards or Pollution Control Committees. Projects requiring prior EC will have the CTE conditions integrated directly into the EC process. The public and stakeholders are invited to submit objections or suggestions within sixty days of the notification's publication.
