Disclosure of Annual Confidential Reports (ACRs) under the RTI Act 2005

This circular clarifies that public authorities are not obligated to disclose Annual Confidential Reports (ACRs) of employees under the RTI Act, 2005, as they contain personal information and are protected by the Official Secrets Act, 1923. However, public authorities retain the discretion to disclose ACRs if they are satisfied that the larger public interest outweighs the protected interests. Any decision to disclose must be approved by the competent authority. This guidance was issued to address the increasing number of RTI requests for copies of ACRs.
